Terms of Service

These Terms govern access to MemorialProof, a service operated by MMAKERS LLC. By creating an account, you agree to these Terms and acknowledge the Privacy Notice.

Who may use the service

You must be at least 18 and authorized to act for the monument retailer whose workspace you create. You are responsible for accurate account information, safeguarding credentials and activity under the account.

Service boundary

MemorialProof records an operational review decision for one exact uploaded proof version and file hash. The retailer remains responsible for design, fabrication instructions, customer authorization and cemetery or other requirements. The service does not provide CAD, legal advice, a legal electronic signature, a cemetery-compliance determination or authorization to fabricate. Reviewers must inspect the underlying proof and make their own confirmations.

Your content and responsibilities

You retain ownership of content you upload. You grant MMAKERS LLC a limited right to host, copy, secure and display that content only as needed to operate, back up and improve the service. You must have authority to upload the proof and share it with the intended reviewer. Do not upload unlawful content, malware, information unrelated to the workflow or content you are not authorized to process.

Evaluation and fees

The current release offers a free 14-day evaluation and does not collect a payment card or make a charge. The displayed $39 per-location monthly price is a planned price, not a current charge. Future paid access requires a separately enabled checkout that clearly presents price and renewal terms before purchase. You may stop using the service or delete the account without a call.

Availability, suspension and termination

We may update the service, apply reasonable usage limits or suspend access needed to protect users, data or infrastructure. We may terminate an account for material breach, unlawful use or security abuse. Account deletion removes active account content subject to the backup-retention period described in the Privacy Notice.

Disclaimers

To the extent permitted by law, the service is provided “as is” and “as available.” MMAKERS LLC disclaims implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that an operational receipt satisfies a retailer's contractual, legal, cemetery or fabrication requirements.

Limitation of liability

To the extent permitted by law, MMAKERS LLC will not be liable for indirect, incidental, special, consequential or punitive damages, lost profits or lost business. Its aggregate liability arising from the service will not exceed the greater of USD 100 or the fees you paid for the service during the three months before the event giving rise to the claim. These limits do not apply where prohibited by law.

Governing law and changes

Delaware law governs these Terms, without regard to conflict-of-laws principles. State and federal courts located in Delaware have exclusive jurisdiction, except where applicable law requires otherwise. We may update these Terms prospectively; the effective date above identifies the current version.
